Hereafter collectively named “ ski-lift company”

GENERAL REMARKS

The confirmation of an order completed online with the ski-lift company, thus implies the compliance of the said person, hereafter named “client”, to adhere to the specific, current online sales conditions.

Should a provision not be fulfilled, it would be considered as according to the current online sales regulations for French based companies.

These present conditions are completed by the «general terms of sale and use of ski-passes » on show at ski-pass sales offices and available online.

Conforming to article 1369-4 of the Code civil (Civil Code), all conditions are made available to clients who can download them should they wish to do so.

The selected type of ski-pass is issued on a medium which determines the domain validity and category.

My Par@diski-carte

From this winter season 2005/2006, a new type of ski-pass « my Par@diski-carte » is on sale. It is only available via the ski-lift company’s on-line sales service. This is a « hands free » ski-pass, produced on an electronic « chip » card, enabling to trigger the turn styles accessing the ski lifts.

This type of pass is made available by the ski-lift company for sales made during the 2005/2006 winter season.

This concerns the following passes:
- All ski-passes from 3 to 15 days (category LES ARCS, PEISEY-VALLANDRY, PARADISKI DECOUVERTE, PARADISKI UNLIMITED)
- Season ski-passes featured on the public ski-pass grid
- Family ski-passes featured on the «family ski-pass grid »
- Promotional rates

LLIFT PASS PHOTOGRAPHS

The sale of any « season » ski-pass, or « 72 yrs and over » ski-pass from three days, is subject to the client providing a photograph. This must be a recent photograph, forward facing without sunglasses or headwear.

Unless otherwise advised by the client, this picture will be saved by the ski-lift company on the computer ticketing system in order to facilitate the re-issue or re-charge of a ski-pass.

TERMS FOR ONLINE ORDERING

The order can only be registered on the Internet site if the client is clearly identified by the following means. Either:
- By entering his/her strictly personal access code (login + password),
- Or by completing the online form which will then attribute an access code.

Completed online orders (including payment, photographs and proof of identity where needed) must be received by the Internet ticketing service no later than two weeks (for abroad) or ten days (for French residents) before the client arrives, in order for the lift-passes to arrive at the requested postal address. In the case where this deadline is not met, the client cannot receive their order at the postal address.

Nevertheless, orders may be completed online (including payment, photographs and proof of identity where needed) with the Internet booking service up to three days before the clients arrival. In this instance, the client must collect his/her ski-passes from a ticketing / sales office, as of the day before the start date of the ski-passes, taking in to account sales office opening hours.

Any order placed is in accordance with any description of the provided services and tariffs.

As per the requirements of article 1369-5 of the Civil Code, the client has the opportunity to check the details of his/her order and the total price. He/she can correct any eventual errors before they acknowledge acceptance.

RATES AND TERMS OF PAYMENT

The prices shown on the internet sites are in euros, including taxes. The VAT rate applied is that which is current at the time of the order. Please note that the postal charges, usually subject for payment in addition to the ski-pass order by the client, will be paid by the ski-lift company for this winter 2005/2006 season.

The online price is due for payment when the order is placed. The following payment methods are accepted:
- Online with credit/bank card Please note that credit card payment is secured via the Crédit Mutuel bank, in association with CYBERMUT (Crédit MUTUEL’s secure “online” payment server), which guarantees payment confidentiality. The payment takes place via a virtual E-payment terminal.

- Cheque raised from a bank account open in France, made payable to the ski-lift company. (off-line payment)

- Chèque-vacances ANCV / Official “Holiday cheques” (off-line payment)

CONFIRMATION THAT THE ORDER HAS BEEN RECEIVED BY THE SKI-LIFT COMPANY

Once the Internet order has been placed and confirmed by the client, the ski-lift company will send an e-mail confirmation that the order has been received.

Regarding online payment, once bank authorisation has been confirmed, the amount will be deducted from the client from the moment the order confirmation is sent to the client. Should bank authorisation for payment be refused, the order will be cancelled. The client will be notified of this no later than seven days after the order has been received. Concerning off-line payments, a receipt that payment has been received will be sent to the client when the ski-lift company receives the corresponding payments (cheque / holiday cheque).

DELIVERY OF THE ORDER

The client may choose:

- Either to have the order delivered to a home address The ski-lift management company (SMA) undertakes to send the ski-passes within nine days for France, and two weeks for abroad, before the start date of the aforesaid ski-passes.

- or to collect the ski-passes from a ski-pass sales office of their choice or an appointed office, as of the day before the start date of the ski-passes, taking in to account sales office opening hours.

A copy of the order receipt is required by the ski-lift company as is a current, valid and official proof of identity. Where this is not provided, the ski-passes will not be issued. The client will be asked to sign a receipt in order to confirm that they have received their order.

CANCELLATION

Anyone purchasing a ski-pass for their stay can purchase specialised insurance protecting against cancellation and/or interruption of their stay, at the time the order is placed.

LIABILITY EXEMPTION

The ski-lift management company is responsible only for means of access for online sales. The ski-lift management company is not responsible for any inconvenience or detriment inherent with the use of the Internet network. This includes system service breakdown, external interruption, computer virus problems and in general, any other issue legally regarded as beyond the control of the ski-lift company.

TERMS OF PROOF

Providing a bank card number online and in general, the provision of a final order confirmation by the client is proof that he/she agrees to the transaction, conforming to the clauses of law n° 2000-230 of March 13th, 2000 and thus due payment regulations.. This confirmation requires signature and express acceptance of all operations carried out by the concerned online sales modules.

INTELLECTUAL PROPERTY

All elements of the Internet site pages which belong to the ski-lift company remain the intellectual property of the aforementioned party. Any copying from these pages, simple link or hypertext links are strictly forbidden without the express prior permission of the company in question.

PERSONAL INFORMATION PROTECTION

Any personal information requested at the time of placing your order is protected by coding mechanism, registered SSL 128.

ARCHIVING

L’archivage des bons de commande est effectué par les services Billetterie-Internet des exploitants conformément à l’article L 134-2 du Code de la consommation.

ADDITIONAL INFORMATION RELATIVE TO THE “GARDERIE” (CHILD -CARE CENTRE):

The child-care centre known as « Les Pommes de Pins » is linked to the SMA (Société Les Montagnes de l’Arc). Child-care services may also be booked online on the Internet site. Please note the specifics regarding child-care reservations:
- All payment must be sent to the Garderie Les Pommes de Pins - Résidence La Nova- 73 700 Arc 1800, at the latest, 5 days before the client arrives.
- Your reservation is not guaranteed and does not commit the SMA until you receive an e-mail confirmation validating your reservation as per the places available.
- The online confirmation you receive for your reservation must be presented to the child-care centre reception the day before the first day of the booking (e.g. Saturday to start Sunday). For the nursery, the client must do this the same day.
- The client will be asked to supply this receipt along with any documents relative to the completion of the corresponding health form.
- In a case where ski-passes are purchased and a reservation for the child-care centre is made simultaneously, the ski-passes must be collected by the client from the child-care centre reception.
